Rouse Avenue Court issues summon to AAP MLA Amanatullah Khan in money laundering case

The Rouse Avenue Court has summoned AAP MLA Amanatullah Khan based on a complaint from the Enforcement Directorate regarding his alleged non-attendance in the Delhi Waqf Board Money Laundering case.

The Additional Chief Metropolitan Magistrate (ACMM), Divya Malhotra, acted on the ED's submissions and initiated proceedings under relevant sections of the law for Khan's non-compliance with summons.

Amanatullah Khan has been directed to appear before the court on April 20, 2024. Special public prosecutor Simon Benjamin represented the Enforcement Directorate in the matter, asserting that Khan's actions had transitioned him from a witness to an accused individual, especially after filing an anticipatory bail plea and evading the investigation process.

The ED's counsel highlighted Khan's repeated avoidance of summons, which hindered the progress of the probe. Benjamin emphasised the gravity of Khan's role in comparison to other accused individuals, indicating a broader involvement.

The recent dismissal of Amanatullah Khan's anticipatory bail plea by the Delhi High Court underscores the principle that elected representatives are subject to the law like any other citizen. The High Court rejected the notion of a separate legal standing for political figures, highlighting the equal application of the law to all individuals.

The High Court's observations pointed out Khan's persistent evasion of ED summons and highlighted concerns over the property transactions under scrutiny, particularly regarding substantial cash payments and contractual employee appointments in the Waqf Board during Khan's chairmanship.

The case revolves around allegations of illegal leasing of ₹100 crore Waqf properties and irregularities in employee appointments during Khan's tenure. With a charge sheet already filed against multiple individuals and a firm, the legal proceedings are shedding light on potential misconduct within the Delhi Waqf Board.
